Experienced driver

The legal limit is 0.5 g of alcohol per litre of blood (i.e. 0.25 mg/L in breath). Above that, it's a 4th-class contravention up to 0.8 g/L, then a criminal offence from 0.8 g/L.

Novice driver (probationary period)

Since 2015, probationary drivers (3 years, or 2 years after AAC) are at 0.2 g/L — roughly one glass. Many are caught off-guard: one drink can cross the line.

Penalties in 2026

Between 0.5 and 0.8 g/L (or 0.2–0.5 for novices)

Fixed fine of €135, 6 points off, vehicle impounded. The judge may add suspension up to 3 years and a mandatory course. For novices, losing 6 points can equal immediate cancellation.

From 0.8 g/L: criminal offence

Fine up to €4,500, 6 points off, licence suspended or cancelled up to 3 years, ban on reapplying for 3 years, up to 2 years in prison, possible vehicle seizure. Criminal record entry.

Repeat offence or refusal to submit

Up to €9,000 fine, 4 years in prison, automatic licence cancellation, obligation to take the test with an alcohol interlock (EAD) for 1 to 5 years.

The alcohol interlock (EAD)

Since 2019, judges may impose an EAD instead of suspension. The driver must blow into a device before starting — if BAC exceeds 0.2 g/L, the engine will not start. Mandatory rental: €100–150/month. In 2026, EAD is used in 8 out of 10 suspensions for repeat offenders.

How long to wait after drinking?

Rough rule: the body clears about 0.15 g/L per hour. After 3 standard drinks (≈ 1.2 g/L), count 7–8 hours before dropping below 0.5 g/L. Individual differences are huge (weight, sex, food): only a breathalyser gives a reliable reading.

Obligation to carry a breathalyser

Since 2020, the obligation to carry a breathalyser in the vehicle has been removed for private drivers but remains strongly recommended. It stays compulsory for bar/nightclub operators. At clubs, chemical breathalysers are freely distributed at the exit.

What to do if caught over the limit?

Cooperate — do not try to hide

Refusing a test is as serious as drink-driving — it's a separate offence. Cooperate, sign the report without commenting, and consult a specialised lawyer within 48 hours to know your options (detention, summons, seizure).
